1. Economeyes Optical is a registered company, company number 04833769 operating from 162 Victoria Road West, Thornton-Cleveleys, Lancashire, FY5 3NE.
2. These terms and conditions govern the supply of goods sold by Economeyes Optical Limited through our website.
3. These terms and conditions set out the rights and obligations that apply where we supply goods to you. Please read them carefully before you place your order as you will be bound by these terms and conditions if you place an order. If you have any questions regarding these terms and conditions please contact us before you place your order.
4. These terms and conditions are governed by and were written in accordance with English law, and may be subject to change without any prior notice to you. However, after an order is placed, we will not change the terms and conditions relating to that order.
5. These terms and conditions do not affect your statutory rights as a consumer.
Contract
1. By submitting your order to us you agree to be bound by the latest terms and conditions, enforced at the time of the order.
2. You must be 16 years of age or over to order from us and you must be neither registered blind nor partially sighted. You must not be ordering on behalf of someone under 16 years of age.
3. Once we have accepted your order and payment has been received, a legally binding contract will exist between you and us.
4. We will meet our responsibilities under this contract within a reasonable time unless it is impossible for us to do this because of circumstances beyond our control. In particular we will not be responsible for delays caused by our suppliers.
Goods and Services
1. The description of our goods is as set out on our website. We will endeavour to ensure that there are no changes to these goods, but it is possible that there could be some variations to the goods by way of manufacturers changing the specifications of the goods they supply to us.
2. All goods are subject to availability. We will inform you by phone or email, within 7 days of the order being placed if an item ordered by you is unavailable.
3. If lenses are to be fitted to a spectacle frame supplied by you, Economeyes Optical Ltd will not be responsible for any breakage of the frame in the course of fitting lenses.
4. By submitting your order to us you agree that all information you submit is valid and true. You agree that the prescription information you enter is exactly the same as the information on the prescription given to you by a registered optician. We will not be held responsible for any errors made by you when inputting your prescription details.
5. You agree that your prescription is less than 2 years old. You agree that if required, you will provide us with a copy of your prescription.
6. If you cannot supply a Pupil Distance (PD) we will use an average PD as calculated through experience.
7. We will refund any money you pay to us should we be unable to supply the requested goods.
8. We have displayed the goods we sell on our website as accurately as possible. However, due to the nature of different monitor displays, and different reproduction techniques of photography and web design, we cannot guarantee any colour description is totally accurate.
Pricing and Payment
1. The price you pay will be the price stated for the chosen goods on our website at the time of you submitting your order, plus the price stated for postage and packing per item on our website at the time of you submitting your order.
2. All prices include VAT.
3. We reserve the right to amend prices at any time without notice, but once an order has been accepted, we will not change the price that applies to that order.
4. You must pay us the full price for goods and postage and packing when placing your order.
5. All payments must be made in UK Pounds Sterling.
6. All payments are subject to authorisation and validation from the credit or debit card issuer, or subject to clearance of your cheque if ordering by mail order . If authorisation or validation is refused by the issuer, or your cheque does not clear, we will not be liable for any delay or failure to deliver.
Despatch and Delivery
1. We will send your goods by the Royal Mail service requested and paid for by you, delivery costs are detailed on our website.
2. We will despatch the goods as soon as possible, normally within 3 - 4 days after the order has been accepted, subject to availability as outlined in the “Goods and Services” section of these terms and conditions. If you do not receive your goods within 14 days of the order being accepted, please contact us immediately.
3. The goods will be sent to the delivery address stated on the secure payment system.
Inspection of Goods
1. Upon delivery of the goods you should carefully inspect them as we will not be held responsible for damage or defects caused by you after you have received them. If any of the goods are lost or damaged, please contact us immediately using the E-Mail address or the telephone number on our website to inform us of the problem and do not use the goods.
Money Back Guarantee
1. You may cancel your order, without reason, within 14 days of despatch by Economeyes Optical Limited.
2. In the event of cancellation you will return the goods and all packaging promptly to Economeyes Optical Limited. The goods must be in the same condition as received by you.
3. Refund will be made within 14 days of receipt of the goods by Economeyes Optical Limited. The refund will be made by the same method as the original payment by you.
4. The refunded amount will be the full payment made but will not include the cost of return of the goods to Economeyes Optical Limited.
5. Refund will not be made if the goods are not received in "as new" condition.
Transfer of Risk and Title in Goods
1. Title in the Goods shall pass to you when the Goods are delivered to the delivery address set out in your Order provided that Economeyes Optical Limited has received payment in full for the Goods.
9.2 Risk in the Goods shall pass to you when the Goods are delivered to the delivery address set out in your Order.
9.3 In the event of cancellation, risk in the Goods remains with you until the Goods are received by Economeyes Optical Limited.
Liability
1. Nothing in this Agreement shall exclude or limit either party’s liability for death or personal injury resulting from that party’s negligence or for fraud or for any other liability that cannot by law be excluded or limited.
2. Subject to the above, the total liability of Economeyes Optical Limited to you in respect of all claims arising out of or in connection with an Order, whether in contract, tort (including negligence or breach of statutory duty), misrepresentation or otherwise, shall not exceed the total sums received by Economeyes Optical Limited for the Goods to which the Order relates.
3. Economeyes Optical Limited shall not be liable to you for any loss of contracts, loss of income or revenue, loss of profits, loss of goodwill or loss of insurance cover.
4. Economeyes Optical Limited shall not be liable to you for any consequential or indirect loss of any kind arising out of or in connection with this Agreement however caused and whether arising under contract, tort, negligence, misrepresentation or otherwise. This exclusion shall apply even if Economeyes Optical Limited has been advised of the possibility of such loss or damage.
5. Economeyes Optical Limited shall not be liable to you where the loss or damage results from information provided by you that is inaccurate, false or misleading or that otherwise results from a breach by you of these Terms and Conditions.
6. Economeyes Optical Limited accepts no liability in respect of any non-standard use of the Goods such as, by way of example only, in extreme sports.
Force Majeure
1. Economeyes Optical Limited shall not be liable for failure to comply with these Terms and Conditions owing to any act or event beyond its control including but not limited to natural disasters, Acts of God, riots, civil commotion, strikes, shortage of supplies, lock-outs, industrial action, war, disease or fire. |
